These Terms of Service (“Terms”) govern your use of Modavestre (the “Site”), operated by MOUNTARARAT LLC. By accessing or purchasing from the Site, you agree to these Terms. If you do not agree, please discontinue use.

1. Eligibility & Account

You must be at least 18 years old and provide accurate information. You are responsible for maintaining account confidentiality and all activities under your credentials.

2. Payment Methods & Security

We accept major credit cards (Visa, Mastercard, AmEx, Discover) and third-party payment gateways including Shopify Payments, Klarna, 2Checkout (Verifone), Paymentwall, and PayPal. All payments are processed through PCI-DSS v4.0 compliant systems with SSL encryption. We never store complete card details.

3. Pricing, Taxes & Availability

All prices are listed in USD unless stated otherwise. Taxes, shipping, and import duties are shown at checkout. We reserve the right to correct errors, update pricing, or refuse orders.

4. Orders & Processing

• Processing: Orders are prepared within 1–3 business days.
• Cancellations: You may request cancellation within 24 hours before shipment.

5. Returns & Refunds

All refunds follow our Refund & Return Policy. Refunds are processed to the original payment method. Shipping fees are non-refundable unless required by law.

6. Disputes & Chargebacks

Please contact support@modavestre.com before filing a chargeback. We may submit transaction and shipping proof to providers (e.g., Klarna, 2Checkout, Paymentwall, PayPal) to resolve disputes. Fraudulent disputes may result in account restrictions.

7. User Conduct

• No unlawful, fraudulent, or abusive activity.
• No interference with website functionality or security.
• No intellectual property or privacy violations.

8. Intellectual Property

All content on this Site, including text, logos, and media, is the property of MOUNTARARAT LLC or its licensors, protected by international copyright law.

9. Disclaimer of Warranties

The Site and its products are provided “as is.” We disclaim all warranties to the maximum extent permitted by law.

10. Limitation of Liability

MOUNTARARAT LLC is not liable for indirect, incidental, or consequential damages resulting from Site or product use.

12. Third-Party Services & Providers

We partner with trusted providers for payments (Shopify Payments, Klarna, Paymentwall, 2Checkout, PayPal), shipping (CJ Dropshipping, DHL, USPS, FedEx), and analytics (Google, Meta). Each operates under their own independent terms and privacy policy.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of New Mexico, USA. Disputes will be resolved exclusively in state or federal courts located in New Mexico.

14. Changes to Terms

We may update these Terms from time to time. Revised versions will be posted here with the latest effective date. Continued use constitutes acceptance.
